Mini Session Photographer/Client Agreement

A. Session Fees

The client agrees to pay the photographer entire session fee at the time of booking to secure their appointment date and time. This fee is non-refundable and non transferable.  The total price of your package covers the time and talent of the photographer, basic retouching and creative editing of images, as determined by the photographer, and all of the digital images to be downloaded by the client from shootproof.com.

B. Location 

Mini Sessions will all be held at the location of the photographers choosing. When booking you are agreeing to the location that has been chosen. Sessions will either be in studio, or an outdoor location. Outside shoots will need to take place either in the early morning or late afternoon/evening. All outside sessions are dependent on weather, if the weather is not cooperating session will be rescheduled at no additional cost to the Client.

C. Rescheduling

Mini sessions are non-refundable if client is unable to make their session time. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. Outside shoots may be rescheduled due to weather at the photographers discretion.

D. Archive

It is your responsibility to download and save your digital files from your online gallery. Galleries are not permanent and will be deleted after 3 weeks. There will be a $25 re-upload fee after 3 weeks. After six (4) months, all images will be purged from the photographer’s hard drive, except as needed for promotional purposes, to be determined by the photographer at the photographer’s sole discretion. The photographer is not responsible for loss or damage to the digital files due to circumstances beyond the photographer’s control.

E. Payment

Payment is due in full at the time of booking. Payment for any extra images must be made prior to final release of images.

F. Model Release

I hereby give to Wild Rose Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:

a) To copyright the same in the photographer’s name or any other name that he/she may select;

b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and;

I hereby release and discharge the photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.

G. Liability

The photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographers from any claims against their person or their business.

H. Copyright & Penalty

Wild Rose Photography retains all copyrights to all images created during the client’s session. A release will be provided with digital files of portraits for personal use. The release does not allow publication of your portraits (i.e. entering in contests), selling, or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, share, alter, or otherwise steal any image created by Wild Rose Photography during a client’s photo session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook, or hard copy images. If the client steals images via any method listed above, or any other method, the client will be invoiced for the cost of EACH digital image client has stolen, at the photographer’s current price per digital file.

Note from the photographer: I work very hard to create images that reflect you and your family while keeping in line with my artistic vision and creativity. I know you will want to share them and include a sneak peek for that very reason. Sharing the images you have purchased on your personal Facebook page is fine, tagging Wild Rose Photography in your images is always appreciated. For a sneak peek of photos please share my link rather than saving and reposting the image on your page. Thank you!

I. Session Requests

*No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless a prior arrangement has been made between client and photographer, including a written agreement. The photographer will not continue if there are other cameras or videotaping during the session.

*Session starts at the agreed upon time. Mini sessions are booked back to back, if you miss your scheduled time there is no refund. If you are late to your session, you will only have the amount of time remaining for your session.
